Terms of Use for BTW App

Welcome to BTW ("App"), a mobile application operated by SPARKED TECHNOLOGIES INC. ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the BTW mobile application, including all features, content, and services provided through the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.

1. Acceptance of Terms

By using the App, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes, subject to these Terms. You may not:

• Copy, modify, or distribute the App or its content without our prior written consent.
• Reverse-engineer, decompile, or disassemble the App, except as permitted by applicable law.
• Use the App for any unlawful or unauthorized purpose.

3. User Accounts

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately at support@onbtw.com if you suspect unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. User Conduct

You agree to use the App in compliance with all applicable laws and these Terms. You must not:

• Post, share, or upload content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Engage in any activity that interferes with or disrupts the App’s functionality or security.
• Use the App to harass, abuse, or harm others or to send unsolicited messages (spam).
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. User Content

You may be able to submit, post, or share content through the App, such as text, images, or other materials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and modify your User Content in connection with operating and improving the App.

You are solely responsible for your User Content and must ensure it complies with these Terms and applicable laws. We reserve the right to remove or moderate any User Content that violates these Terms or is otherwise deemed inappropriate, at our sole discretion.

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of Fire App Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any of our intellectual property without our prior written permission, except as expressly permitted under these Terms.

7. Third-Party Services and Links

The App may contain links to or integrations with third-party websites, services, or resources. We are not responsible for the content, availability, or practices of these third parties. Your use of third-party services is at your own risk and subject to their respective terms and policies.

8. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your license to use the App will cease, and you must stop using the App and delete it from your device. Any provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability) will continue to apply.

9. Disclaimers

The App is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Fire App Inc., its affiliates, and their respective officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the App. Our total liability for any claims under these Terms will not exceed $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fire App Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in Texas, USA, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated Terms in the App or sending you a notification. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
